# TERMS OF SERVICE

## 1. About these Terms
These Terms of Service explain the terms on which we sell products to you through our website.
Please read these Terms before placing an order. By placing an order, you confirm that you accept these Terms. Our Refund & Returns Policy and Shipping Policy also apply to your order and form part of the contract between you and us.
Nothing in these Terms limits any rights you have under UK consumer law.

Customer support hours are Monday to Friday, 9:00 am to 5:00 pm UK time, excluding Bank Holidays in England and Wales. We aim to respond within one to two working days.
Our online store is hosted by Shopify, which provides the ecommerce platform used to display products, take orders and process payments.
## 3. Who may order
Our website is intended for people aged 18 or over.
If you are under 18, a parent or legal guardian must place the order for you. The person placing the order is responsible for providing accurate information and paying for the order.
We currently sell only to customers with a United Kingdom delivery address accepted at checkout.
## 4. One-off purchases only
We do not currently offer subscriptions, recurring payments or automatically renewing contracts. Each order is a separate, one-off purchase.
## 5. Products
We take reasonable care to ensure that product descriptions, photographs, sizing information, materials, colours and other product details are accurate.
Colours may appear slightly different depending on your device display. Measurements described as approximate may be subject to minor reasonable variations. These points do not affect your rights if a product is materially different from its description, is faulty or does not otherwise comply with the contract.
Please review the product description and available sizing information before ordering. Product availability is subject to stock.
We may withdraw a product or change its description or price before an order is accepted. A change will not affect an order we have already accepted.
## 6. Prices and delivery charges
All prices are displayed and charged in Pounds Sterling (GBP).
We are not currently registered for VAT and do not charge UK VAT. Product prices shown are the total price payable for the product itself.
Standard Evri Tracked delivery costs **£3.99 per order** for addresses accepted within our stated delivery area. We do not currently apply a general free-delivery threshold. Any separate delivery promotion will state its conditions clearly.
The applicable delivery charge and total amount payable will be displayed before you place the order and before payment is taken. No optional charge will be added unless you actively select or agree to it.
We take reasonable care to ensure prices are correct. If we identify an obvious pricing error before accepting an order, we will tell you and give you the opportunity to order at the correct price or withdraw your order. We will not require you to pay an increased price without your agreement.
## 7. Payment
You may pay using the payment methods displayed at checkout.
Payments are processed by Shopify and the payment providers shown during checkout. We do not receive or store your complete payment-card number.
By submitting payment details, you confirm that you are authorised to use the selected payment method. If payment cannot be authorised, the order will not be accepted.
## 8. How the contract is formed
The checkout pages allow you to review and correct your order before submitting it.
When you place an order, you make an offer to buy the products in that order. An automated order acknowledgement confirms that we received your order, but does not mean that we accepted it.
We accept your order when we send a dispatch confirmation email. At that point, a contract is formed for the products listed in that dispatch confirmation.
If products from one order are dispatched separately, a separate contract is formed for each dispatch when its dispatch confirmation is sent.
Before or no later than delivery, we will provide the required contract and cancellation information by email or another durable format that you can save.
We may decline an order before acceptance where, for example:
- a product is unavailable;
- payment cannot be authorised;
- the delivery address is outside our delivery area;
- there is an obvious error in the product description or price;
- applicable law prevents us from fulfilling it; or
- we have reasonable grounds to suspect fraud or misuse.
If we cannot accept an order, we will notify you and promptly return any payment or payment authorisation relating to it.
## 9. Cancelling before dispatch
You may withdraw your order before it has been accepted by contacting us at **shop@lalaboutique.co.uk**.
Once a contract has been formed, you may still have the statutory right to cancel described in our Refund & Returns Policy. If an order has already been dispatched, you may need to return it after delivery.
## 10. Delivery
We use Evri Tracked for UK deliveries.
Orders are normally processed within one to two working days. Delivery is then normally estimated to take a further two to four working days after dispatch.
Further details, including the delivery charge, tracking, delays and postcode restrictions, are set out in our Shipping Policy.
Unless a different delivery period is expressly agreed with you, we will deliver without undue delay and no later than 30 days after the contract is formed.
## 11. Risk and ownership
We remain responsible for the goods while they are being delivered by Evri.
Risk passes to you only when you, or a person identified by you other than the carrier, takes physical possession of the goods. If you independently arrange for a carrier that we did not offer, risk may pass when the goods are delivered to that carrier, as provided by law.
You own the goods once we have received payment in full and the goods have been delivered.
## 12. Change-of-mind cancellations and returns
For most online purchases, you have the right to cancel without giving a reason from the date the contract is formed until 14 days after the relevant goods come into your, or your nominated recipient’s, physical possession.
After notifying us of cancellation, you normally have a further 14 days to send the goods back.
Full instructions, exceptions and refund arrangements are set out in our Refund & Returns Policy. Sale and discounted products have the same statutory cancellation and quality rights as full-price products.
## 13. Faulty, damaged, misdescribed or incorrect goods
Goods must be of satisfactory quality, fit for any purpose made known to us, match their description and comply with other applicable contractual requirements.
If a product is faulty, damaged, misdescribed or not the product you ordered, please contact **shop@lalaboutique.co.uk**. Our Refund & Returns Policy explains the available remedies and how return costs are handled.
Nothing in these Terms replaces or reduces your statutory remedies. Depending on the circumstances and timing, these may include the short-term right to reject, repair or replacement, a price reduction or a final right to reject.
## 14. Promotions and discount codes
Promotions and discount codes may have specific terms, eligibility requirements and expiry dates. These will be made clear when the promotion is offered.
Unless a promotion states otherwise:
- only one discount code may be used per order;
- a code cannot be exchanged for cash;
- a code cannot be applied retrospectively to a completed order; and
- the code must be used before its stated expiry date.
We may correct or withdraw a promotion prospectively if it contains an obvious error or is affected by fraud or technical misuse. This will not remove rights under an order we have already accepted.
Promotional and sale products remain covered by your statutory rights.
## 15. Complimentary gifts
An order may include a complimentary gift, subject to availability.
A complimentary gift:
- is supplied without a separate charge;
- does not need to be returned if you cancel or return the purchased products;
- has no separate cash or refund value; and
- cannot normally be exchanged separately.
Please contact us if a complimentary gift appears faulty or unsafe. Nothing in this section excludes any legal rights that apply to it.
## 16. Customer accounts
You may be able to place an order as a guest or through a customer account.
If you create an account, you are responsible for keeping your login details confidential and taking reasonable steps to prevent unauthorised access. Please tell us promptly if you believe your account has been used without permission.
We may suspend an account where reasonably necessary to investigate fraud, security threats, illegal activity or a material breach of these Terms. Suspending an account will not remove your rights under an existing order.
## 17. Reviews and customer content
Reviews must reflect a genuine experience with the relevant product or our service.
We prohibit:
- fake reviews;
- reviews submitted by someone who did not have the experience described;
- reviews purchased or commissioned to mislead customers;
- concealed incentivised reviews;
- false or misleading review information; and
- reviews containing unlawful, abusive, defamatory or irrelevant material or another person’s private information.
Where a review was submitted in return for payment, a discount, a complimentary product or another incentive, that incentive must be disclosed and we will clearly label the review where it is published.
We may take reasonable steps to verify a reviewer’s purchase or experience. We do not remove a genuine, relevant and lawful review merely because it is negative.
If you submit text, photographs or other content, you confirm that you own it or have permission to submit it and that any identifiable person shown has agreed to the submission.
You retain ownership of your content. You grant us a non-exclusive, royalty-free licence to host and display it on our website and related LALA BOUTIQUE channels for the purpose for which it was submitted. You may ask us to stop future use, subject to legal retention requirements and material already lawfully produced or published.
We may reject or remove content where we reasonably believe it breaches this section or the law.
## 18. Intellectual property
The website and its original text, branding, graphics, photographs and design are owned by or licensed to Jagoda Bąkowska trading as LALA BOUTIQUE. Supplier materials remain the property of their respective owners.
You may view the website and download or print reasonable extracts for personal, non-commercial use. You must not reproduce, distribute, commercially exploit or modify our protected content without permission, except where the law permits.
## 19. Acceptable website use
You must not:
- use the website unlawfully or fraudulently;
- attempt to gain unauthorised access to the website or related systems;
- introduce viruses or harmful code;
- interfere with the website’s security or operation;
- impersonate another person; or
- use automated systems to extract substantial website content in breach of applicable law.
We may take proportionate action to protect the website and other users. This will not affect rights relating to an existing order.
## 20. Privacy
We process personal information in accordance with our Privacy Policy.
Please read the Privacy Policy before ordering or providing personal information. Shopify and the payment, delivery and technology providers identified in that policy may process information to provide the store and fulfil orders.
## 21. Our responsibility to you
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for loss or damage that is not foreseeable, that results from inaccurate instructions supplied by you, or that is caused entirely by circumstances for which we are not legally responsible.
We remain responsible for delivery carried out by a carrier selected by us.
Nothing in these Terms excludes or restricts liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot lawfully be excluded;
- breach of the statutory rights applying to goods; or
- any other liability that cannot lawfully be excluded or restricted.
## 22. Events outside our reasonable control
If an event outside our reasonable control delays or prevents performance, we will take reasonable steps to reduce its effect and tell affected customers when appropriate.
This does not remove our responsibility for the courier we select or your statutory delivery, cancellation, refund or quality rights.
If delivery is materially delayed, you may have the right to set an additional reasonable delivery period or cancel the affected contract, as explained in our Shipping Policy.
## 23. Complaints and alternative dispute resolution
Please send complaints to **shop@lalaboutique.co.uk** or to our postal address. Include your order number and enough information for us to investigate.
We aim to acknowledge ordinary customer complaints promptly and provide a substantive response as soon as reasonably possible.
If we cannot resolve a consumer complaint after completing our internal process, we will provide the name and website of an approved alternative dispute resolution entity capable of dealing with the dispute and tell you whether we are obliged or prepared to use that procedure.
You remain free to seek independent advice and to use the courts.
## 24. Changes to these Terms
We may update these Terms for future website use and future orders. The updated version and revision date will be published on this page.
The terms provided to you and in force when your order is accepted will continue to apply to that order. We will not retrospectively change an accepted contract without your agreement or a lawful reason.
## 25. Transfer of rights
We may transfer our rights and obligations under a contract only where this does not reduce your rights or protections.
You may transfer your rights where the law permits. We may require reasonable evidence of the transfer.
## 26. Severability and waiver
If a court or relevant authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.
A delay in enforcing a right does not mean that the right has been waived.
## 27. Third-party rights
The contract is between you and Jagoda Bąkowska trading as LALA BOUTIQUE. Unless the law provides otherwise, no other person has a right to enforce it.
## 28. Governing law and courts
These Terms and contracts made under them are governed by the law of England and Wales.
If you live in Scotland, Northern Ireland or another part of the United Kingdom, you retain the benefit of mandatory consumer protections applicable where you live. You may bring proceedings in the courts of the part of the United Kingdom where you live or in the courts of England and Wales. We will not use this section to prevent you from using your local courts where consumer law gives you that right.
